This Privacy Policy explains how Nodifire, Inc., a Michigan corporation doing business as Hey Nghbr™ ("Nodifire," "Hey Nghbr™," "Company," "we," "us," or "our"), collects, uses, discloses, retains, and protects personal information when you use our products and services, including the Hey Nghbr™ platform and any related websites, mobile applications, features, or services (collectively, the "Services").
By accessing or using the Services, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree with our practices, please do not use the Services.
For California Residents: This Privacy Policy contains disclosures required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"). Please see Section 12 for additional information about your California privacy rights.
1. INFORMATION WE COLLECT
We collect personal information in the following ways: (a) information you provide directly to us; (b) information collected automatically when you use the Services; and (c) information from third-party sources.
1.1 Information You Provide
We collect information you voluntarily provide, including:
Account Information: Name, email address, phone number, username, password, date of birth, city, state, neighborhood, and profile photo.
User Content: Reviews, recommendations, photos, comments, ratings, check-ins, saved places, and local experience guides you create or submit.
Preferences: Interests, favorite categories, dietary preferences, accessibility needs, and other preferences you choose to share.
Business Information: For Business Account holders: business name, address, hours, contact information, photos, descriptions, and payment information.
Curator Information: For Curators: tax identification information (W-9), payment details for revenue sharing, and content portfolio.
Communications: Messages, feedback, support requests, and other communications you send to us or through the Services.
Survey and Research Data: Responses to surveys, questionnaires, or research studies you choose to participate in.
1.2 Information Collected Automatically
When you use the Services, we automatically collect:
Device Information: Device type, operating system, unique device identifiers, browser type and version, mobile network information, and hardware model.
Usage Information: Pages viewed, features used, searches performed, clicks, scroll behavior, time spent on pages, referring URLs, and navigation paths.
Log Data: IP address, access times, date and time stamps, error logs, and system activity.
Location Information: We collect location information as described in Section 2 below.
1.3 Information from Third Parties
We may receive information from third-party sources, including:
Social Media Platforms: If you connect a social media account, we may receive your profile information, friends list, and other information you authorize.
Business Data Providers: We may obtain publicly available business information (names, addresses, hours, categories) to create or enrich business listings.

2. LOCATION INFORMATION
Because Hey Nghbr™ is designed to help you discover local businesses and experiences, location information is important to how the Services function. We collect and use location information as follows:
2.1 Types of Location Information
Approximate Location: We derive approximate location (city or region level) from your IP address. This is collected automatically and used to show relevant local content.
Precise Location: With your explicit consent, we may collect precise geolocation data (GPS coordinates within approximately 1,850 feet) from your mobile device. This enables features like nearby recommendations and check-ins.
Location You Provide: You may manually enter location information such as your neighborhood, city, or places you have visited.
2.2 How We Use Location Information
We use location information to: (a) show you relevant local businesses, places, and recommendations; (b) enable location-based features such as check-ins and nearby searches; (c) personalize your experience based on your location; (d) provide businesses with aggregated, de-identified insights about foot traffic and engagement; and (e) improve the accuracy and relevance of the Services.
2.3 Your Location Choices
You can control location collection through your device settings. You may disable precise location access at any time, though this may limit certain features. Even if you disable precise location, we may still derive approximate location from your IP address. California residents have the right to limit the use of precise geolocation data as described in Section 12.
2.4 Sensitive Locations
We do not use precise geolocation data to infer sensitive characteristics about you, such as health conditions, religious beliefs, or political affiliations. We do not sell or share precise geolocation data with third parties for their own marketing purposes.
3. HOW WE USE YOUR INFORMATION
We use personal information for the following purposes:
Providing Services: To operate, maintain, and deliver the Services, including enabling discovery, recommendations, community features, and account functionality.
Personalization: To personalize your experience, including showing relevant local content, recommendations, and features based on your location, preferences, and activity.
Communications: To send you service-related communications, respond to your inquiries, and provide customer support.
Marketing: To send promotional communications about products, services, features, and events (you may opt out at any time).

4. HOW WE SHARE YOUR INFORMATION
4.1 We Do Not Sell Personal Information
Nodifire does not sell your personal information. We do not exchange personal information for monetary consideration.
4.2 Sharing for Cross-Context Behavioral Advertising
We do not currently share personal information with third parties for cross-context behavioral advertising. If this changes, we will update this Privacy Policy and provide you with the opportunity to opt out.
4.3 Categories of Recipients
We may disclose personal information to the following categories of recipients:
Service Providers and Contractors: We share information with vendors who perform services on our behalf, including cloud hosting, payment processing, email delivery, analytics, customer support, and security services. These providers are contractually obligated to use personal information only for the purposes of providing services to us.
Other Users: Information you choose to make public (such as your profile, reviews, recommendations, and check-ins) is visible to other users. Your privacy settings control certain visibility options.
Businesses: We may share aggregated, de-identified data with businesses about engagement with their listings (e.g., number of views, saves, check-ins). We do not share your personal information with businesses unless you choose to interact with them directly (such as making a reservation or contacting them through the platform).
Legal and Safety: We may disclose information when required by law, subpoena, court order, or government request; to protect the rights, property, or safety of Nodifire, our users, or others; to enforce our Terms of Service; or to respond to emergencies.
Business Transfers: In connection with a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction, your personal information may be transferred to the acquiring entity. We will provide notice before your personal information becomes subject to a different privacy policy.
5. BUSINESS AND AGGREGATED DATA
The Services display business-related and aggregated data, such as popularity indicators, engagement metrics, category trends, saves, check-ins, recommendations, and other insights about places, businesses, and listings. This aggregated information does not identify individual users and is not considered personal information under applicable privacy laws. This information may be visible to other users, businesses, and partners to help people discover and understand local activity.
6. PUBLIC CONTENT AND USER VISIBILITY
Content you choose to make public—such as reviews, recommendations, photos, check-ins, and profile information—may be visible to other users and searchable within the Services. Your username and profile photo may be displayed alongside your public contributions. You can control certain visibility settings through your account. Please be mindful that public content may be copied, shared, or indexed by third parties, and we cannot control how others use publicly available information.
7. COOKIES AND TRACKING TECHNOLOGIES
7.1 Types of Technologies
We use the following technologies:
Cookies: Small text files stored on your device that help us recognize you, remember your preferences, and understand how you use the Services.
Pixels and Beacons: Small graphic files that track user activity and collect usage data.

8. DATA RETENTION

Account Information: Retained while your account is active and for up to three (3) years after account closure for legal, audit, and dispute resolution purposes.
User Content: Public content remains visible until you delete it. Upon deletion, content is removed from public view within a reasonable time but may persist in backups for up to ninety (90) days.
Transaction Records: Payment and transaction information is retained for seven (7) years for tax, accounting, and legal compliance purposes.
Usage Data: Log files and analytics data are generally retained for up to two (2) years in identifiable form, after which they may be aggregated or anonymized.
Location Data: Precise location data is retained only as long as necessary for the specific purpose for which it was collected, typically no longer than thirty (30) days in identifiable form.
9. DATA SECURITY
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit and at rest, access controls, regular security assessments, and employee training. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security. 12. CALIFORNIA PRIVACY RIGHTS
This section provides additional disclosures required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA), and applies to California residents.
12.1 Categories of Personal Information Collected
In the preceding twelve (12) months, we have collected the following categories of personal information: (a) Identifiers (name, email, phone number, IP address, device identifiers); (b) Personal information under Cal. Civ. Code 1798.80(e) (name, address, phone number); (c) Commercial information (transaction history, subscription status); (d) Internet or network activity (browsing history, search history, interactions with the Services); (e) Geolocation data (approximate and, with consent, precise location); (f) Audio, electronic, visual information (photos you upload); (g) Professional or employment information (for Business Account holders); (h) Inferences drawn from the above to create a profile reflecting preferences; and (i) Sensitive personal information (precise geolocation, account login credentials).
12.2 Sources of Personal Information
We collect personal information from: (a) directly from you; (b) automatically through your use of the Services; (c) social media platforms you connect; and (d) third-party business data providers.
12.3 Purposes for Collection and Use
We collect and use personal information for the business and commercial purposes described in Section 3 of this Privacy Policy.
12.4 Disclosure of Personal Information
In the preceding twelve (12) months, we have disclosed the following categories of personal information to service providers and contractors for business purposes: Identifiers, Personal information under Cal. Civ. Code 1798.80(e), Commercial information, Internet or network activity, and Geolocation data.
12.5 Sale and Sharing
We do not sell personal information. We do not share personal information for cross-context behavioral advertising.
12.6 Sensitive Personal Information
We collect precise geolocation data (with your consent) and account login credentials, which are considered sensitive personal information under the CCPA. We use this information only for the purposes disclosed in this Privacy Policy and as permitted by law. You have the right to limit the use and disclosure of sensitive personal information. 12.7 Your California Rights
As a California resident, you have the right to:

Residents of Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws may have similar rights to access, correct, delete, and opt out of certain processing of personal information. 14. INTERNATIONAL DATA TRANSFERS
Nodifire is based in the United States. If you access the Services from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. By using the Services, you consent to the transfer of your information to the United States and other jurisdictions where we or our service providers operate. We take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.
15. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we make material changes, we will notify you by posting the updated Privacy Policy on the Services with a new "Last Updated" date and, where required by law, by email or other means. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Privacy Policy. We encourage you to review this Privacy Policy periodically.
